CONDITIONS
OF SALE DESCRIPTION
GUARANTEE:
Unless sold AS IS, HMC will accept within 30 days from shipment any machinery and equipment sold with return privilege, freight prepaid, for refund of the purchase price if proven mechanically unsatisfactory; or repair at dealer's option. Buyer is responsible for all freight charges. This guarantee applies only to machines, which we own. The machine must be returned in the same condition that it left HMC's warehouse. HMC shall not be responsible for any damages done by truckers, riggers, or other parties. Machines damaged in shipping are not covered under the return privilege. HMC reserves the right to void the return privilege or charge a restocking fee if purchase is made without physical inspection by buyer or their representative. Any machine sold AS IS means there is no warranty, guarantee or return privilege. All AS IS sales are final, no refunds.
TERMS:
We accept cash, check, Visa or Master Card with order. All machines are quoted Loaded on Truck Our Warehouse York, Pennsylvania, unless otherwise stated. All machines offered are subject to prior sale and prices quoted are exclusive of any government sales tax. Machinery descriptions are intended as a guide only and their accuracy is not guaranteed. Machines paid via credit card require a 3% transaction fee and are subject to a restocking charge if returned.
CONDITIONS:
There are no warranties which extend beyond the description of the face hereof. Quotations subject to change without notice. All agreements and/or contracts made by salesmen or representatives are subject to approval by Home Office - Hildebrand Machinery Co., Inc.
MACHINE SAFETY:
It is the buyers and user's responsibility to provide proper safety devices, training and equipment to safeguard the operator from harm for any particular use, operation or set up, and to adequately safeguard the machine, or machines, to conform to all Federal, State and Local Government Safety Standards and All Industry Safety Standards.
INDEMNIFICATION:
User agrees to indemnity and hold harmless Seller of and from any and all claims or liabilities from accidents involving these machines caused by failure of user, his employees, or agents to follow instructions, warnings, or recommendations available from the original manufacturer, or by failure of user to comply with Federal, State and Local laws applicable to such equipment including the Occupational Safety and Health Act of 1970.
